DECREE
ON ENACTMENT OF THE LAW ON THE FLAG AND THE COAT
OF ARMS
OF FEDERATION OF BOSNIA AND HERZEGOVINA
The
Law on the flag and the coat of arms of Federation
of Bosnia and Herzegovina passed by the Federation
Parliament in the session of the House of Representatives
held on November 6, 1996 and in the session of the
House of Nations held on November 6, 1996 is enacted.

LAW
ON THE FLAG AND THE COAT OF ARMS
OF FEDERATION OF BOSNIA AND HERZEGOVINA
Article
1
The
Coat of Arms of Federation of Bosnia and Herzegovina has a shape
of a shield and consists of three parts: in the top left part, on
one quarter of the coat, is a shield with a golden lily on the green
background; in the top right part, on one quarter of the coat, is
a historical Croat coat of 25 red and white square fields; in the
blue bottom part of the coat are 10 white six spoke stars forming
a circle and taking up one half of the coat. The coat and the blue
field are framed with a golden stripe.
Article
2
The
flag of Federation of Bosnia and Herzegovina is rectangular with
three colors lined vertically from left to right:
red, white and green. In the middle of the flag is the coat of arms
of Federation of Bosnia and Herzegovina described in Article 1 of this
Law. The white field is three time the width of the red or the green
field. Ratio between width and length is 3:5.

Graphics
of the coat of arms and the flag of Federation of Bosnia and Herzegovina
are integral parts of this Law.
Article
4
There
will be a separate Law passed about the use of the coat of arms and
the flag of Federation of Bosnia and Herzegovina.
Article
5
This
Law goes into force the day it is published in the Official Gazette
of Federation of Bosnia and Herzegovina.

LAW ON AMENDMENTS TO THE LAW ON THE COAT OF ARMS AND THE FLAG OF
FEDERATION OF BOSNIA AND HERZEGOVINA
Article
1
In
the Law on the coat of arms and the flag of Federation
of Bosnia and Herzegovina (Official Gazette of Federation
of BiH no. 21/96), in Article 1, third row, the semicolon
behind the word "background" is deleted and
the following is added: "framed with a golden stripe" and
in the fifth row, the semicolon behind the word "fields" is
deleted and the following is added: "framed with
a red stripe" and in the seventh row, the full stop
behind the word "coat" is deleted and the following
words are added: "and both the shield with the golden
lily and the historical Croat coat are on the white background.

2
In
the Article 3, a new paragraph 2 is added stating: "The
graphics standards of the coat of arms and the flag of
Federation of Bosnia and Herzegovina, as well as the
position of the coat of arms and its size on the flag
are integral parts of this Law. "

This
Law goes into force the day it is published in the Official
Gazette of Federation of BiH. Chairman of the House of
Nations, Mr. Mariofil Ljubic. Deputy Chairman of the
House of Representatives, Mr. Stjepan Mikic.

The
Law on use of the flag and the coat of arms of Federation
of Bosnia and Herzegovina passed by the Federation Parliament
in the session of the House of Representatives held on
December 18, 1996 and in the session of the House of
Nations held on December 19, 1996 is enacted.

LAW ON USE OF THE COAT OF ARMS AND THE FLAG OF
FEDERATION OF BOSNIA AND HERZEGOVINA
I - GENERAL PROVISIONS
Article
1
This
Law regulates the use of the coat of arms and the flag
of Federation of Bosnia and Herzegovina (hereinafter
referred to as: the Federation).
Article
2
The
coat of arms and the flag represent the Federation and
express belonging to the Federation.
Article
3
The
coat of arms and the flag of the Federation shall be
used in accordance with provisions of this Law in the
manner expressing the reputation and dignity of the Federation.
Article
4
The
coat of arms and the flag are to be displayed in accordance
with a separate regulation.
Article
5
The
coat of arms and the flag of the Federation shall be
used only in the form and contents specified in the Law
on the coat of arms and the flag of Federation of Bosnia
and Herzegovina (Official Gazette of Federation of BiH,
no. 21/96). No changes shall be made to the coat of arms
and the flag. Exceptionally, if specified by special
regulations, the coat of arms and the flag can be used
as integral parts of other emblems or signs (military,
command and ranking flags, etc.).
Article
6
The
originals of the coat of arms and the flag are kept by
the Federation President and coat of arms and the flag
shall be shaped based on them.
Article
7
The
coat of arms and the flag can not be used as a goods
or service stamp, sample or a model, nor in any other
way to mark goods or services.
Article
8
Use
of coat of arms and the flag of the Federation is allowed
in artistic work or for educational purposes provided
that the reputation and dignity of the Federation are
not offended.
Article
9
The
coat of arms and the flag of the Federation can not be
used in public if damaged or in its appearance seem inadequate
for use. Coat of arms and flag which are damaged or inadequate
for use shall be withdrawn from use.
Article
10
If
the coat of arms and the flag of the Federation are displayed
on the territory of the Federation together with other
domestic or foreign coat of arms or the flag, the coat
of arms and the flag of the Federation shall be placed
on the honorary place, in accordance with this Law, except
in the case described in the Article 4 of this Law.

II - USE OF THE FEDERATION COAT OF ARMS
Article
11
The
coat of arms of the Federation shall be used:
1. As a part of the seal of the Federation in accordance with the Law
on the seal of Federation of Bosnia and Herzegovina (Official Gazette
of Federation of Bosnia and Herzegovina, no. 2/94 and 21/96);
2. In official premises and signs on buildings where the bodies of
the Federation are located;
3. In buildings marking the border of Bosnia and Herzegovina on the
territory of the Federation, according to special regulations;
4. On uniforms of employees of Federal Ministry of Internal Affairs,
uniforms of guards of federal institutions for execution of punishment
sanctions, uniforms of customs officers and financial police;
5. In other cases in accordance with the law.
Article
12
The
coat of arms of the Federation can be used:
1. On buildings where cantonal, city and municipal authorities are
located in the territory of the Federation, as well as in ceremonial
premises of such buildings;
2. On buildings where units, departments, command posts and quarters
of the army of the Federation are located, as well as in ceremonial
premises of such buildings;
3. During international events, competitions and other gatherings (political,
scientific, cultural and artistic, sports, etc.) where the Federation
is participating or is represented in accordance with the rights and
the practice of such gatherings;
4. On official invitations, greeting cards and similar documents used
by the President of the Federation, Vice-president of the Federation,
chairmen of both of Parliament Houses, the Prime Minister and Deputy
Prime Minister, Ministers and other officials of the Federation;
5. In other instances, if the use is not contrary to provisions of
this Law.
Article
13
If
the coat of arms of the Federation is displayed on the
territory of the Federation together with one or more
domestic or foreign coats of arms or other similar emblems,
the Federation coat of arms shall be placed in an honorary
spot, as follows:
1. In the middle of the circle looking at the front, if other coats
of arms and emblems are forming a circle;
2. In the middle of the semicircle looking at the front, if other coats
of arms and emblems are forming a semicircle;
3. Heading a column of other coats of arms, if other coats of arms
and emblems are forming a column;
4. Heading a group of other coats of arms, if coats of of arms are
forming groups;
5. On the right side, looking at the front, of the coat of arms of
the country displayed in the center, except in cases of official visits
of states or international organizations when the use conforms to the
regulation referred to in Article 4 of this Law.

III - USE OF THE FLAG OF THE FEDERATION
Article
14
The
flag of the Federation shall be displayed:
1. On the building where the Federation Parliament, Federation President
and Vice-president, and the Government of the Federation are located;
2. On the days of holiday in the Federation on buildings where authorities
are located during that holiday;
3. On uniforms of the army of the Federation when the army of the Federation
is participating as a member of international military units;
4. When the President and the Vice-president of the Federation are
leaving the country and when they are returning from abroad into the
Federation;
5. On the means of transportation used by the President and the Vice-president
of the Federation;
6. On mourning days declared by the Government of the Federation at
half-mast during those days;
7. In other cases under conditions and in the manner specified by the
Law.
Article
15
The
flag of the Federation can be displayed:
1. On buildings where cantonal, city and municipal authorities are
located, during festivities in those cantons, cities and municipalities;
2. In buildings where units, departments, command posts and quarters
of the army of the Federation are located, during festivities in those
units, departments, command posts and quarters;
3. During international events, competitions and other gatherings (political,
scientific, cultural and artistic, sports, etc.) where the Federation
is participating of is represented in accordance with rights and the
practice of such gatherings;
4. During festivities and other mass political, cultural, sports and
similar events, which are of importance to the Federation;
5. In other cases, if the use is not contrary to provisions of this
Law.
Article
16
If
the flag of the Federation is displayed on the territory
of the Federation together with other flags, the Federation
flag shall be placed on an honorary spot, as follows:
1. In the middle of the circle, looking at the front, if flags are
forming a circle;

2. In the middle of the semicircle, looking at the front, if other
flags are forming a semicircle in accordance with the regulation referred
to in the Article 4 of this Law;
3. Heading a column of other flags - if other flags are forming a column;
4. Heading a line, looking at the front, - if other flags are forming
a line;
5. Heading a group - if other flags are forming groups.
If the flag of the Federation is displayed next to some other flag,
it shall always be located on the left side, looking at the front.
Article
17
If
the flag of the Federation is displayed across the street
or a square, on a table, a podium, or in another honorary
place in the vertical position, the position of the flag
must be such that the red field is turned to the upper
side.
Article
18
The
flag of the Federation shall be raised and lowered, displayed
and taken off and transported with usual honors (standing
up, saluting, etc.).

IV - PENALTY PROVISIONS
Article
19
A
fine of DM 1,500 up to DM 7,500 shall be paid by the enterprise
or other legal entity if:
1. It uses the coat of arms or the flag of the Federation in the form
or contents contrary to provisions of Article 5 of this Law;
2. It uses the coat of arms or the flag of the Federation as a sign for
marking goods or services (Article 7);
3. It uses the coat of arms or the flag contrary to provisions of the
Article 8 of this Law;
4. It uses in public the coat of arms or the flag which are damaged or
in its appearance inadequate for use (Article 9);
5. It uses or displays the coat of arms and the flag contrary to provisions
of Articles 4, 12 and 15 of this Law;
6. It does not use or display the coat of arms and the flag of the Federation
in accordance with provisions of Articles 10 and 13 of this Law.
In case of violation referred to in paragraph 1. of this Article, the
responsible party in the enterprise, authority or another legal entity
shall also be fined between DM 300 and DM 750.
Article
20
In
case of violation referred to in the Article 19 paragraph
1 of this Law, the person running a handicraft store shall
be fined between DM 300 and DM 750.
In case of violation referred to in the Article 19 paragraph 1 points
1, 2, 3 and 4 of this Law, a citizen shall be fined between DM 100 and
DM 400.
Article
21
A
fine referred to in Articles 19 and 20 of this Law shall
be paid in DM or in the currency of Bosnia and Herzegovina
as the equivalent value based on the average exchange rate
determined and published by the Central Bank of Bosnia
and Herzegovina on the date of the payment.
Until the currency to be established by the Central Bank of Bosnia and
Herzegovina is established, the currency established by the National
Bank of Bosnia and Herzegovina shall be used.
Article
22
Whoever
commits a violation referred to in Articles 19 and 20 of
this Law, can also be a subject of a protective measure
to take away the item used to commit the violation.
The authorized person of the Federal Ministry of Internal Affairs can
take away items referred to in paragraph 1 of this Article and submit
them to the relevant authority before the request for initiation of litigation
is filed.

- FINAL PROVISIONS
Article
23
This
Law goes into force the day after it is published in the
Official Gazette of Federation of BiH.
